Can I file Chapter 13 if I filed Chapter 7 6 yrs ago? I really need some help! in a huge bind…?

I really need some help here with this one. I filed chap 7 after a restaurant of ours went under it is coming up on 6 years now. Now I know that they just changed the law to be 8 years, but can I file chapter 13? We are 2 months behind on our mortgage… the payment is one that we can no longer afford, and have sold off every valuable thing we own just to keep paying this rediculous mortgage! My husband lost his job and is having alot of trouble finding another one. I work full time, and am trying everywhich way I can to pull in extra money. We are 3 monts behind on our credit cards, so our credit rating is now shot – so re-financing is out. House is on the market, but I don’t think we are going to get what we owe. We are thinking to just let it go – forclosure, figure something with the credit cards…. rent something with the 2 kids & pets! Any sound advice on what to do here? The phone is ringing off the hook with creditors!

Bankruptcy stays on your credit report for 7 to 10 years. You can consult with a lawyer but I don’t think you will be able to
file. You can write letters to the creditors to make them stop calling. If they contact you after receiving the letters (give it two weeks after mailing) then don’t delete your caller ID,
if they try and contact you and hang up it is harassment,
if they leave a message then it is a violation of the FCRA,
